Mark Lundy seeks third appeal, this time through the Supreme Court

Mark Lundy has sought a third appeal as he maintains his innocence after being convicted of double murder.

Convicted of the double murder of his wife Christine and daughter Amber Lundy in Palmerston North in 2000, Mark Lundy was convicted in 2002.

In 2013 he took his case to the Privy Council where his convictions were quashed and a re-trial took place in 2015, however he was again found guilty.

Mark Lundy has now sought a Supreme Court appeal.

However, a decision has been reserved today by two judges at the Supreme Court as to whether Lundy's lawyers will be given leave to appeal his double convictions for murder.

They're arguing mainly about evidence used at trial, namely the spinal cord or brain tissue identified on Lundy's shirt as being that of Mrs Lundy's.

Jonathan Eaton (lawyer for Lundy) says it was not definitive and that other things were also identified in the sample such as scalp flakes and that the reliance put on that evidence for conviction wasn’t credible.

He is seeking an appeal claiming an unfair trial and that the basis of inevitable guilt was flawed.
