Green MP Darleen Tana and the publishers of an Auckland magazine have been referred to police over an advertisement published before last year's election.

It comes after an alleged failure to include a promoter statement in the election advertisement, published in May 2023, which promoted Tana as a candidate.

An election advertisement must contain a promoter statement under electoral laws.

The Electoral Commission announced it made the referral late this afternoon.

A spokesperson for the commission said it has decided to name the individuals referred to police as "the Green Party has already spoken publicly about the matter".

"As this matter is now with the police, the Electoral Commission will not be commenting further," they said in a media release.

"The Electoral Commission has referred Darleen Tana MP and the publishers of Verve Magazine to police over an alleged failure to include a promoter statement in an election advertisement published in May 2023."

The Green Party referred the advertisement to the Electoral Commission last month.

Tana, a first-term MP, is already suspended from her duties as an MP as her party investigates her involvement and level of knowledge regarding unrelated allegations of migrant exploitation involving her husband's company.

The independent investigation into the MP's knowledge of migrant exploitation allegations has now stretched into its 14th week with no stated deadline.
