Josef Fritzl, the Austrian man who imprisoned and raped his daughter for nearly a quarter-of-a-century, has applied for release from prison into a care home.

Fritzl was jailed for life in 2009 for the rape, incest and incarceration of his daughter Elisabeth.

She gave birth to seven children, with a court finding one of them was killed by Fritzl after it was deemed he failed to seek medical help for it.

His lawyer Astrid Wagner said a recent psychiatric report ruled Fritzl was no longer a threat, The Guardian reported.

He was living with dementia and should be allowed to live out his days in a care home.

Fritzl, 88, is being held in a high security unit.

An Austrian media court psychiatrist in 2009 described him as "extremely psychologically abnormal" and "emotionally illiterate", but recently concluded he was no longer dangerous.

In 2008 Elisabeth managed to communicate with police that she was being held captive, after her father allowed her to go to hospital when one of her children fell critically ill.

Her father had lured her into a cellar underneath the family home when she was 18.

Ftitzl told his wife their daughter had run away to join a cult.
