Witness tells court 14-year-old accused admitted stabbing man in attack outside Flaxmere pub

The jury in the trial of 14-year-old Haami Hanara has been shown CCTV footage of the teenager holding what police say is a bloodied knife while riding a bicycle.

Hanara is on trial in the High Court in Napier, accused of murdering 40-year-old Hawke's Bay man Kelly Donner in Hastings in March.

CCTV vision played to the courtroom shows Mr Donner involved in an altercation with five youths outside The Flax Bar and Eatery.

Mr Donner's family were also present in the courtroom as the vision was played numerous times.

Hanara can be seen holding what police say is a knife, as the fight moves in and out of frame.

Mr Donner and the teenagers can be seen throwing bottles and concrete at each other, before Mr Donner has a bike thrown at his back. It appears to strike him on the shoulder.

At this point the youths pelt Mr Donner with bottles and pieces of broken concrete, causing him to retreat out of the frame and turn his back.

The footage then shows Hanara running after Mr Donner, followed by the rest of the group.

It's while the group are off camera that the Crown alleges Hanara stabs Mr Donner four times, twice to the neck. This severs his carotid artery that supplies blood from the heart to the brain.

The group then re-enter frame and scatter in different directions, with Hanara seen mounting a bike with what police say is the knife still in his left hand.

Detective James Forgie of the Hawke's Bay Police analysed the footage and told the court he believes Hanara's shoes are covered in blood when he flees the scene.

A black vest that was worn by Hanara on the night of the attack was analysed by ESR Scientist Janina Hopkins, who also gave evidence.

She told the court numerous stains on the vest tested positive for blood and the staining pattern indicated the blood would have been transferred through contact.

A knife was also found in a flax bush near the crime scene. It rained heavily the day and night before it was found. Testing found no DNA or blood on the knife.

BLOODIED KNIVE

The court also heard from a teen who involved in the attack, who said the accused had a bloodied knife in his hand and told her that he had stabbed Mr Donner.

The teenager, who cannot be identified, gave evidence this morning via audio visual link from a youth justice facility.

She has previously been before the Youth Court. 

She told the court how the group had planned to rob a liquor store for alcohol and get drunk on the night of March 5.

They entered a caged area of the  Flax Bar and Eatery, looking for tools to use in the robbery.

There, they met Mr Donner who was looking for cigarette butts.

She says the accused asked Mr Donner for the torch he was using to look through the trash and when Mr Donner wanted it back, Hanara refused.

She claims Mr Donner then got aggressive, so the group started smashing bottles on his head.

The fight then moved out to the field outside the tavern where the group began to throw bottles and broken concrete at Mr Donner.

The witness told the court how she saw the accused punch the victim four or five times in the neck area while he was on the ground. They then all ran in and started kicking him.

She said she could see blood all over Mr Donner as she and the other teenagers attacked him.

The group then fled to a nearby picnic table where the teenager said she saw Mr Hanara holding a knife with a cream coloured handle with the blade covered in blood.

“He said he stabbed him and we should run” she told the court under questioning from Crown Prosecutor Steve Manning.

She said at this point Mr Donner was lying on the ground motionless and they all fled the scene.
