Homeless man sues couple who he claims used $400K in donations meant for him, on luxury spending for themselves

A homeless man in the US is suing a Philadelphia couple after they raised more than $US400,000 to help him get back on his feet but are now allegedly using the funds to pay for lavish trips and a new BMW.

Johnny Bobbitt's act of kindness towards stranded motorist Kate McClure went viral after he used his last $US20 to help her pay for her petrol last November, BBC reports.

Ms McClure and her boyfriend, Mark D'Amico, started a GoFundMe to pay back his kindness, eventually raising more than $US400,000.

Mr Bobbitt alleges the couple sold his camper, gambled away some of the money donated to him, and have declined to provide financial records.

The former US Marine veteran told the Philadelphia Inquirer that he is unable to access the remaining $US200,000 raised, which Mr D'Amico said would be dispensed to Mr Bobbitt once he gets a job and stops his drug use.

Mr D'Amico said, "Giving him all that money, it's never going to happen. I'll burn it in front of him", adding that the large sum would be akin to giving Mr Bobbitt "a loaded gun".

Mr Bobbitt said, "I think it might have been good intentions in the beginning, but with that amount of money, I think it became greed."
